Terms and Conditions

1. Contract

These Terms and Conditions form the contract between O40BW Pty Ltd (“O40BW”, “we”, “our”, “us”) and the person(s) booking and/or participating in the Over 40s Bushwalking British Columbia Tour 2026 (“the participant”, “you”, “your”).
By making a booking and paying the deposit, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Booking and Payments​

2.1 Deposit

A non-refundable deposit of AUD $500 per person is required at the time of booking to secure your place on the tour.

 

2.2 Final Payment

The balance of the tour cost is due 90 days prior to the tour’s departure date. Bookings made within 90 days of departure must be paid in full at the time of booking.

 

2.3 Payment Methods

Payments can be made via bank transfer, credit card (fees may apply), or other approved methods as specified by O40BW.

 

3. Cancellations by the Participant

Cancellations must be received in writing by email or post. The following fees apply:

Timing of Cancellation - Cancellation Fee

More than 30 days prior to departure - 50% of total tour price

Within 30 days of departure -100% of total tour price (no refund)

The $500 deposit is non-refundable under all circumstances.

No refunds will be made for unused services or for participants who fail to join, leave, or are removed from the tour once it has commenced.

 

4. Cancellations or Alterations by O40BW

O40BW reserves the right to cancel, postpone, or amend any tour prior to departure due to insufficient numbers, force majeure events, or circumstances beyond our control (including but not limited to natural disasters, political instability, pandemics, or transport disruptions).

If O40BW cancels the tour, participants will be offered:

  • A transfer of funds to an alternative departure, or

  • A refund of monies paid (less unrecoverable third-party costs).

O40BW is not liable for any incidental or consequential expenses (such as flights, visas, or travel insurance costs) resulting from such cancellation or change.

 

5. Pricing

All prices are quoted in Australian Dollars (AUD) and are based on current exchange rates, tariffs, and operational costs.
O40BW reserves the right to adjust prices due to changes in exchange rates, taxes, park fees, or supplier increases.

 

6. Participant Fitness, Health, and Responsibilities

This is an active hiking adventure requiring a reasonable level of fitness, mobility, and endurance.
Participants are responsible for ensuring they are physically capable of completing the walks and activities outlined in the itinerary.

  • You must disclose any medical conditions, injuries, or dietary requirements prior to departure.

  • O40BW and its guides reserve the right to refuse participation to anyone deemed physically unfit or unsafe to continue a hike or the tour.

  • Participants agree to comply with the instructions of guides and leaders at all times for personal safety and group wellbeing.

Failure to do so may result in removal from the tour without refund.

 

7. Travel Insurance

Comprehensive travel insurance is compulsory for all participants and must include cover for:

  • Trip cancellation and curtailment

  • Medical expenses (including evacuation)

  • Baggage and personal effects

  • Adventure activities such as hiking and camping

Proof of insurance must be provided prior to departure.

 

8. Passports, Visas, and Entry Requirements

Participants are responsible for ensuring they have a valid passport (minimum 6 months validity) and any required visas or Electronic Travel Authorisations (eTA) for entry into Canada.

O40BW is not responsible for any loss, delay, or cost arising from incorrect documentation or denial of entry.

 

9. Equipment and Gear

Participants must provide their own personal camping and hiking equipment, including but not limited to:

  • Tent, sleeping bag, sleeping mat

  • Daypack

  • Hiking boots and weather-appropriate clothing

A full equipment checklist will be provided upon booking confirmation.

Failure to bring appropriate gear may impact your ability to safely participate.

 

10. Assumption of Risk

Participation in outdoor adventure activities such as hiking, camping, and travel in remote areas involves inherent risks including, but not limited to:

  • Uneven or steep terrain

  • Variable weather conditions

  • Wildlife encounters

  • Accidents, illness, or injury in remote areas

By joining the tour, you acknowledge these risks and voluntarily assume all responsibility for personal safety and well-being.

O40BW, its employees, guides, and agents accept no liability for any loss, damage, injury, or death arising from participation, except where required by law.

 

11. Limitation of Liability

To the fullest extent permitted by law:

  • O40BW’s liability for any claim arising from this contract is limited to the amount paid for the tour.

  • O40BW is not liable for indirect, incidental, or consequential losses, including lost enjoyment, emotional distress, or additional travel expenses.

You agree to release, indemnify, and hold harmless O40BW, its employees, agents, and contractors from all claims, demands, or actions arising from participation in the tour, except where such loss is caused by O40BW’s proven negligence.

 

12. Force Majeure

O40BW is not liable for any delay, change, or cancellation due to events beyond its reasonable control, including but not limited to:

  • Acts of God

  • Natural disasters, fire, flood, or weather events

  • War, civil unrest, terrorism, or government restrictions

  • Pandemic, quarantine, or health emergencies

In such cases, O40BW will make every reasonable effort to reschedule or provide an alternative arrangement. Additional costs arising from these events will be the participant’s responsibility.

 

13. Images and Marketing

You consent to O40BW using any photographs or video images taken during the tour for promotional and marketing purposes, without compensation.
Please notify your guide prior to departure if you do not wish to appear in marketing materials.

 

14. Complaints and Disputes

Any issues or complaints during the tour should be reported immediately to the tour leader or O40BW representative to allow prompt resolution.
Unresolved disputes must be submitted in writing within 30 days of tour completion.

This contract is governed by the laws of New South Wales, Australia, and any disputes shall be subject to the jurisdiction of the courts of that state.

 

15. Acceptance of Terms

By submitting a booking and payment to O40BW Pty Ltd, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, including all risk warnings and liability exclusions.
